At the Federal High Court in Abuja, Adeyemo, a legal representative of Sunday Igboho, activist for Yoruba, has asked the State Security Services (SSS) and its director-general to mandate and obtain the 12 persons arrested in Sunday Igboho’s house on 2 July and to investigate circumstances which have been the basis for their arrest and detention since that date.
The counsel of Chief Yomi Aliyu (SAN) in a motion Exparte filed at the Court, as amended and within the competence of the Court of Appeal, requesting that the Court order the DSS to produce in accordance with Sections 32(1) and (2) of the Criminal Justice Act 2015 and Sections 6(6)(b), 35 940 and 36(5) of the Constitution of the Federal Republic of Nigeria 1999 (as modified and within the jurisdictions of the Court).
The motion detailed FHC/ABJ/CS/647/2021 and further requested that the court give the circumstances that it deems appropriate for such orders.
The 12 applicants are Abdullateef Ofeyagbe, Amoda Babatunde alias Lady K, Tajudeen Erinoye, Diekola Ademola, Abideen Shittu, Jamiu Noah, Ayobami Donald, Adelabe Usman, Oluwapelumi Kunle.

The basis on which the motion against the Directorate of State Securities was filed included the allegation that the State Security Service, which denied them access to lawyers and members of their family as a result, was frustrated since their arrest and detention of efforts by their lawyers to obtain access to them and to provide legal representation as provided by law.
Chief Aliyu (SAN) also stated in the motion that, despite the clear provisions of the law, which place a charge of charges against suspects within 24 hours of the time of their arrest on the law, the DSS blatantly disobeys the law and keeps the twelve persons in jail without charge from the competent tribunal.
He added that, within a reasonable time under the applicable laws of Nigeria, the petitioners are aware of the constitutional protection of the presumption of innocence and of fair trial.
In support of this motion, a five paragraph written address in support of the motion signed by Chief Aliyu and five other lawyers, and a display marked Exhibit A, a letter from counsel to DSS to request a visit by the client, which was c. the motion, were submitted by Binta Baldeh Geena, the female litigation secretary in the counsel firm for applicants.
The resolution also contained an affidavit in 11 paragraphs of Extreme Urgency and a no-multiplicity affidavit, likewise submitted on 8 July 2021 by the same secretary of the proceedings, Binta Baldeh geena.
For hearing the Exparte motion, no date has been determined.
