Tax: DSTV Has Been Ordered By Court To Pay 50% of 1.8 Trillion Naira To FG

The Tax Appeal Tribunal (TAT) has asked Multichoice Nigeria Limited, the proprietors of famous cable television service DSTV, to pay 50% of N1.8 trillion in tax revenue that the Federal Inland Revenue Service (FIRS) claims they failed to send to the government.

According to a statement from Abdullahi Ismaila Ahmad, PhD, Director, Federal Inland Revenue Service’s Communications and Liaison Department, the five-member TAT panel, chaired by Professor A.B. Ahmed, made the order in response to a request from the Counsel to FIRS.

Following a dispute with FIRS over the issuing of Notices of Assessment and Demand in the amount of N1, 822, 923,909,313.94k on April 7, 2021, Multichoice Nigeria Limited filed the complaint in the Lagos office of TAT.

According to the FIRS, the amount was owed in taxation from Multichoice to the Federal Government of Nigeria following a multi-month inquiry into the extent to which Multichoice had been dodging taxes in Nigeria.

Multichoice Nigeria Limited, on the other hand, modified its Notice of Appeal at Tuesday’s hearing and requested an adjournment of the proceedings through its counsel, Bidemi Olumide.

It said the request for adjournment is to allow it to respond to the FIRS’ formal application for Accelerated hearing of the Appeal, which directs Multichoice to present before the Tribunal the integrated Annual report and Management Account Statements of Multichoice Group Ltd for Tax Years 2012 to 2020, among other prayers.

In response, the FIRS Counsel requested that an order be issued compelling Multichoice to make a statutory deposit of 50% of the disputed amount.

TAT approved the FIRS submission after receiving both sides’ arguments and ordered Multichoice Nigeria Limited to pay with the FIRS an amount equivalent to 50% of the Evaluations under the Appeal plus a sum equivalent to 10% of the said deposit as a condition necessary for any further Hearing of the Appeal.

The TAT rescheduled the hearing for September 23, 2021, to receive a report on the Tribunal’s order and to continue the hearing, subject to the Tribunal’s order is followed.
