Trump And El Salvador’s President Bukele Refuse To Return Wrongly Deported Maryland Man Despite Supreme Court Ruling

During an Oval Office discussion on Monday, April 14, US President Donald Trump and El Salvador’s President Nayib Bukele firmly stated that Kilmar Armando Abrego Garcia, a Maryland resident mistakenly deported to El Salvador, will not be permitted to return to the United States.

This position persists despite a U.S. Supreme Court decision mandating that the federal government “facilitate” Abrego Garcia’s return. White House officials contend that although the ruling requires facilitation, it does not obligate El Salvador to agree. When CNN’s Kaitlan Collins directly questioned President Bukele about returning Abrego Garcia, he rejected the idea outright.

“I hope you’re not suggesting that I smuggle a terrorist into the United States,” Bukele said. “How can I smuggle a terrorist into the United States? Of course I’m not going to do it. The question is preposterous.”

The Supreme Court’s concise, unsigned ruling upheld a prior order from U.S. District Judge Paula Xinis, which directed the U.S. government to take steps to enable Abrego Garcia’s return. Nonetheless, the justices noted that while the government must “facilitate” the process, it is not obligated to “effectuate” it—a nuanced yet critical difference.

Senior White House officials have resisted Judge Xinis’ directive, asserting that it infringes on the executive branch’s prerogative to manage foreign affairs. Recently, President Trump has altered his stance. Initially indicating he would honor the Supreme Court’s decision, he has since aligned with the White House’s perspective.

“If the Supreme Court said bring somebody back I would do that. I respect the Supreme Court,” Trump stated last week. Yet, he has taken no actions to implement the ruling.

Abrego Garcia is said to have entered the U.S. unlawfully around 2011. In 2019, an immigration judge evaluated his case and ruled against deportation, citing credible gang threats in El Salvador against his family due to their pupusa business. Despite this decision, he was deported later under contested circumstances.
